Forest Produce Rules: A Legal Battle for Traders' Rights
In a significant legal move, traders involved in the forest produce business have taken their grievances to the High Court in Dodoma, seeking to challenge government regulations that they claim are detrimental to their livelihoods. The traders, represented by Mr. Mohamed Tibanyendera, argue that the recent amendments to the forest produce regulations, published in Government Notice No. 132, have been imposed without adhering to the necessary legal procedures.
The regulations, introduced on February 22, 2025, modify the guidelines set forth in Government Notice No. 153 of 2004, which govern the harvesting of forest produce. The traders, including prominent companies like Kirungi Kingalu Company Limited and Micco Import and Export Company Limited, are concerned about the impact of these changes on their operations.
Mr. Tibanyendera highlights a critical issue: the traders are required to pay royalties on the entire tree, even though they are only permitted to harvest the logs. This discrepancy has led to significant financial burdens, as the traders argue that they are effectively paying for the entire tree without being able to utilize all its parts. The Tanzania Forest Services (TFS) has enforced these regulations in a way that the traders deem unjust, particularly regarding the quantity of forest produce they can collect and the use of branches and leaves.
The traders' application to the High Court seeks to have the regulations declared null and void, citing non-compliance with established law-making procedures. They are also requesting other remedies to ensure fair treatment and the protection of their rights. Mr. Tibanyendera emphasizes that the traders have paid substantial sums for permits, only to encounter altered procedures when attempting to collect their authorized forest produce.
